Catholic Church Initiates Review of Christian Marriage Act, 1872

The Pakistan Catholic Bishops’ Conference (PCBC), through the Catholic Archdiocese of Karachi, has initiated a comprehensive review of the Christian Marriage Act, 1872, aimed at bringing the legal framework governing Christian marriages in Pakistan in line with contemporary requirements.

According to a statement issued by Archbishop of Karachi His Grace Benny Mario Travas, a special committee has been constituted within the Catholic Archdiocese of Karachi to conduct an in-depth examination of the existing law from legal, constitutional and ecclesiastical perspectives.

The committee will particularly examine issues concerning religious freedom, the religious and sacramental nature of Christian marriage, the identity and distinct requirements of different Christian denominations and the ecclesiastical autonomy of the Catholic Church.

It will also assess the legal and practical requirements of the present era to determine what amendments may be necessary in the existing framework.

Following detailed consultations and review within the Church, the committee will formulate proposals, recommendations and proposed amendments. These will subsequently be presented to the Pakistan Catholic Bishops’ Conference for consideration.

The PCBC will then place its recommendations before the federal and provincial governments and other relevant authorities for deliberation.

The initiative seeks to develop a comprehensive framework for Christian marriage in Pakistan that is consistent with constitutional requirements and religious freedom while addressing contemporary legal and practical needs.

Archbishop Travas expressed his commitment to advancing the matter through constructive and meaningful dialogue with the government, legislative institutions, legal experts and other relevant stakeholders.

According to the statement, the fundamental objective of the exercise is to establish a fair, clear, constitutional and coherent legal framework that safeguards the Christian community’s religious freedom, the religious and sacramental character of marriage and the ecclesiastical requirements of the Church.

The Catholic Church also reiterated its commitment to continued consultation and cooperation with all relevant stakeholders, saying its eventual recommendations would be presented to the appropriate government institutions through established legal and constitutional procedures.
