The special CBI court acquits all 32 accused, senior BJP leaders, in the 28-year-old case, for lack of proof. All the 32 people were accused of criminal conspiracy and instigating a mob to tear down the Mughal-time mosque in the northern town of Ayodhya, located about 84 miles east of the state capital, Lucknow, in 1992. The demolition aroused countrywide communal violence that left about 2,000 people dead, large number of them Muslims. On the day of the leveling, Advani kept announcing on microphone that law enforcing forces should not be permitted near the mosque. Pravin Jain, a photographer, who was there on the day of the demolition, mentioned that he saw preparation in advance of demolition of mosque. He has given proof before Liberhan Commission and astononisshingly CBI never asked me to testify which is proof that they had already decided the results.
The retired judge, who headed the commission of inquiry and took about 17 years to submit his report on the subject to the union government, stated that there was lot of evidence available to prove conspiracy and fault of these leaders and to disclose convincingly the pre- designed conspiracy behind the destruction of the debated structure of the Babri Masjid. He stated that the court’s verdict is completely opposed to the conclusions of the commission. Court says there is no concluding proof of a conspiracy to the mosque; the retired judge, who headed the commission of inquiry on the matter, says the judgment is entirely fake. A huge mosque of this size coming down within a span of only five hours without any scheme or without any preparation on the part of anybody is unreasonable to think. Asserting on whether the Centre and the state would appeal against the verdict or not, given both are presently led by the BJP, the possibility of appeal is highly not possible. Had the verdict charged of the 32 accused that were all freed of the charge of conspiracy, the case would have gone on with appeals and ended, if required, with a presidential pardon. There was no path Prime Minister Narendra Modi would have permitted released the 92-year-old Advani, known his teacher in the Hindustan association, to go to jail. The court considered said there was no clear evidence of a conspiracy to raze the Babri Masjid. Mr Advani’s role and others, were there Anjou Gupta, a police officer who was with Mr Advani on December 6, gave proof before a CBI special court that Advani made an emotional speech before the mosque was demolished by the Hindu volunteers who had gathered. When the Hindu volunteers were destroying the Babri Masjid none of the BJP leaders who were present, including Advani, made any efforts to stop them. Once the mosque was leveled, the BJP leaders distributed sweets, as stated by Gupta. Some of them were part of the mob that leveled the mosque said that BJP leaders including Advani, Joshi and Uma Bharti, told them to it. In 1989, the BJP openly announced that the construction of a Ram temple on the land where they believed Lord Ram was born and where the Babri Masjid had stood for above 400 years. Advani initiated chariot march from Somnath to Ayodhya, the object of which was to arouse support for the demand for the construction of a Ram temple at the place where the mosque stood. This is a wrong judgment as it is against evidence and against law. Last year, India’s Supreme Court awarded the bitterly controversial mosque site to Hindus, handing the BJP a victory to drive home its Hindu nationalist agenda. In its ruling last November, the top court ordered the full disputed area of 2.77 acres to be allocated to Hindus for the construction of the temple. The verdict was a large defeat to Muslims, who also claim the land. The court did say the demolition of the mosque was a criminal act. It also asked the government to provide five acres of land to Muslims at another location as a replacement for the land they had lost. Last month, Modi inaugurated the construction of the temple, which was one of the pledges the BJP made when the party was founded in the 1980s. The party rose to national fame on the back of the temple movement.
The court went to say that the politicians were actually trying to stop the crowd. Almost 30 years after Babri Masjid was destroyed by extremist Hindu looters, the special court hearing the related case has acquitted all of the living suspects for absence of evidence. After all these years, no one will go to jail for the destruction of the mosque. Many will say that they run the corrupted system that India’s ruling Bharatiya Janata Party has created. The ruling party has managed to get terrorists’ convictions turned down so that they may contest elections. The fact that these terrorists could actually win their seats should serve as a reminder of the direction in which Indian society is going on. In this example, all the court needed to convict was testimony that the mosque’s destruction was well scheduled. The court believe that thousands of rioters just showed up, with no by the dozens of politicians who had been calling for the destruction of a mosque that just happened to also be in Ayodhya and was also called Babri Masjid. The accused politicians were actually trying to stop the crowd. It only blamed anti-social elements.
