The Government of Sindh has established Consumer Protection Courts in each District of Sindh Province as per orders of Honourable High Court of Sindh. Now every Consumer has right to approach Consumer Court free of Cost, there is no need to engage any advocate or pay any Court fee on his/her claim.
Consumer can file claim against any shopkeeper, institution (private or Govt.) where he/she purchase any product or hire any services and the said product or services are defective or faulty.
There is no limit of the claim. The Consumer can claim unlimited compensation and damages without paying any Court Fee.
The 15 days’ notice is not necessary to be sent through any advocate however, it may be sent by the LEFT Consumer on simple paper addressing his/her grievance.
The Consumer shall file the claim/complain within 30 days from the date when such defect in product or faulty services came into his/her knowledge.
The Consumer is required to submit or produce purchasing receipt of product or engaging any services and produce proof of service of 15 days’ notice upor opposite party at the time of filing the claim.
In case the Consumer fails to submit his/her claim within 30 days due to some reasons, he/she can even file condonation application stating the reasons for non-filing the claim within stipulated time and if the Court finds it reasonable, he/she can be allowed to file such claim.
The claim/complain of Consumer shall be decided by the Court within 06 months after appearance of opposite party.
WHAT ORDERS COURT CAN PASS
The defective product can be replaced with new one. The price/cost of product can be returned/refunded. The reasonable compensation and damages can be granted for loss suffered by claimant.
The Violator can be punished with imprisonment upto two years and may be fined upto rupees One Lac.
