Chief Justice of Pakistan (CJP) Qazi Faez Isa ruled on Thursday that once ballot boxes are opened, Form 45 or Form 75 no longer hold any legal significance. This observation was made during a hearing where the Supreme Court dismissed a petition filed by Pakistan Peoples Party (PPP) candidate Ghulam Rasool regarding the recounting of votes in the Balochistan Assembly Constituency PB-14, Naseerabad.
The court upheld the victory of Pakistan Muslim League-Nawaz (PMLN) candidate Muhammad Khan Lehri, citing the absence of substantial evidence to support the allegations of electoral fraud made by the petitioner.
CJP Isa emphasized that in the context of elections, the actual votes are the most crucial evidence, while Form 45, filled by presiding officers, holds little importance once the ballot boxes have been opened. He advised the petitioner’s counsel to focus on presenting facts and legal arguments rather than simply accusing the presiding officers of bias.
The court ultimately ruled in favor of PMLN candidate Lehri, rejecting the request for a recount at the seven contested polling stations.
