Alleged Misuse of Section 9 raises merit, seniority concerns in Punjab Education Dept

LAHORE: Serious concerns have emerged within the Punjab School Education Department over the alleged misuse of Section 9 of the PCS Act 1974, with stakeholders claiming that merit and seniority principles are being undermined through the appointment of junior officers to senior positions while eligible senior officers are being overlooked.
Despite the stated commitment of Chief Minister Punjab Maryam Nawaz and Punjab Education Minister Rana Sikandar Hayat to promote transparency and quality education in the province, insiders allege that certain elements within the department are bypassing established rules and regulations. According to officials familiar with the matter, several junior officers have been posted to higher positions over the past two years, even though qualified and experienced senior officers were available within the cadre.
Section 9 of the PCS Act 1974 grants the government administrative authority to post civil servants to positions under its control. However, observers within the department argue that this provision is meant to be used in limited circumstances, particularly when no eligible officer of the required grade is available. Legal experts maintain that the section is intended for temporary administrative requirements and should not serve as a mechanism for long term or regular postings that sideline seniority norms.
Departmental sources claim that the frequent application of Section 9 over the last two years has raised questions regarding fairness and transparency. Senior officers reportedly believe that while the government possesses discretionary powers, the spirit of the law emphasizes merit as its core principle. They argue that assigning junior officers to senior posts despite the availability of competent senior officers contradicts both administrative ethics and established service rules.
Education sector representatives warn that prolonged continuation of such arrangements may adversely affect institutional morale and discipline. While temporary postings may be justified in exceptional circumstances to ensure continuity of administration, extended placements of junior officers in higher posts are said to disrupt the administrative hierarchy and weaken confidence within the service structure.
Stakeholders further allege that political interference and external pressure may be contributing to the unrest within the department. Senior officers contend that overlooking eligible candidates not only demotivates experienced personnel but also results in the underutilization of highly qualified officers who possess the competence and expertise required for senior leadership roles.
According to service law experts, Section 9 must operate strictly within the legal framework and cannot override established principles of seniority without compelling administrative justification. Transparency, fairness and equal opportunity, they emphasize, are fundamental to maintaining institutional integrity.
Representatives from the education sector have appealed to the provincial government to take immediate notice of the situation. They have urged Chief Minister Maryam Nawaz, the Education Minister and the Secretary of the School Education Department to conduct a comprehensive review of all postings made under Section 9 from Grade 17 to Grade 20 over the past two years.
Stakeholders are demanding that detailed data be collected and evaluated to determine whether the appointments were made in accordance with merit and legal requirements. They argue that such scrutiny is essential to restore confidence among officers and ensure that seniority rights are protected.
Observers believe that addressing these concerns through a transparent merit based review would strengthen institutional discipline and enable officers to contribute more effectively toward the shared goal of improving the quality of education in Punjab. Without corrective measures, they warn, the continued perception of favoritism may erode morale and hinder the overall administrative efficiency of the School Education Department.
